Terms and Conditions «miis Furttal»
1. Scope of Application
These general terms and conditions apply to the miis Furttal project of the Standort- und Wirtschaftsförderung Furttal (hereinafter SWFF). The miis Furttal project introduces sports and leisure activities in the Furttal region. It consists of a website miisFurttal.ch and the miis Furttal app. Topics include sports (biking, jogging, culture, and hiking), What's Happening in Furttal, Attractions, and Eat & Sleep. The app offers the possibility to receive notifications about events and dates in Furttal. By using the digital services of miis Furttal (miisfurttal.ch or miis Furttal app), individuals agree to the following conditions.
2. Obligations / No Warranty
The use of information, offers, and services of the website miisFurttal.ch and the miis Furttal app is without obligation on the part of SWFF. SWFF strives to present a current offering in the mentioned topics. The section "What's Happening" is automatically updated every 6 hours from the Furttal municipal websites and is non-binding.
Although SWFF has taken all due care to ensure the reliability of the information contained on the website and app at the time of its publication, SWFF makes no explicit or implied representation or warranty (including to third parties) regarding the accuracy, reliability, or completeness of the information on the miis Furttal website and app. Opinions and other information on the miis Furttal website and app may be changed at any time without notice.
SWFF assumes no responsibility and provides no guarantee that the functions on the websites and app will not be interrupted or that the miis Furttal website and app or the respective server are free of harmful components.
3. Challenge / Participation Conditions
3.1. General
Users of the app can participate in time-limited challenges and thus in advertised competitions. The competition rules are set in the respective challenges. Participation in the challenges is at one's own risk.
3.2. Eligibility for Participation / Entitlement to Win
To participate, an alias, email address, and age must be provided during registration. Participants must be 16 years of age or older. To participate in the challenges, it is necessary for all personal information to be truthful. Participants must have their residence in Switzerland. Participants from abroad are not eligible to participate. Participants can only participate for themselves. Participation for other individuals is prohibited. Participation is free and does not require any conclusion of a legal transaction.
By participating, users accept these terms and conditions. Depending on the challenge, additional conditions may apply. Moreover, specific game rules may apply, which are published with the respective game. By participating in a challenge, the participant accepts not only these participation conditions but also the respective game rules.
3.3. Data Protection
The registered personal data and any scanner data of scanned QR codes are collected for the duration of the challenge and for notifying the results (winnings). Data will not be passed on to third parties.
By registering, the participant agrees that SWFF may store all data for the duration of the challenge and beyond.
The Standort- und Wirtschaftsförderung Furttal, 8105 Regensdorf, is responsible for compliance with data protection regulations. In addition, reference is made to the data protection declaration Project miis Furttal.
3.4. Exclusion from the Challenge
In the event of a breach of the competition rules, SWFF reserves the right to exclude the respective individuals from the challenge.
All individuals who use unauthorized aids or otherwise gain advantages through manipulation will be excluded from participation. In such cases, winnings can also be retrospectively revoked and reclaimed.
3.5. Implementation
The technical implementation of the challenges is the responsibility of SWFF. SWFF provides signage for the routes as a suggestion. The exact procedure of the challenges is described in the competition rules. Participation is at one's own responsibility. Insurance is the responsibility of the participant.
Persons aged 16 and over with residence in Switzerland are eligible to win. Winners will be notified by email. Instant prizes may be possible in a challenge. At the end of each challenge, a prize will be drawn among all participants. Legal recourse is excluded. The announcement of the winners is without guarantee. All cash prizes will be transferred to the winner by bank transfer. With the transfer of the cash prize, SWFF is released from its obligation to perform. If a payment cannot be made, for reasons not attributable to SWFF, the prize as well as all claims against SWFF will expire.
In the case of non-cash prizes, the winner must collect the prize themselves from the sponsoring company. In such cases, the winner will be informed of the dealer responsible for delivering the prize. By naming the responsible company (via the app or email), SWFF is released from any obligations. If the winner does not collect their prize from the responsible company within a certain period, communicated to them in advance, the prize will expire. The collection deadline will be communicated to the winner in advance. All costs incurred by collection, as well as any subsequent costs (taxes, fuel, repairs, insurance, etc.), and any transport damage incurred (from the collection point) are the sole responsibility of the winner.
Cash payments of non-cash prizes or replacement of prizes are not possible. A claim to the prize is not transferable to another person. In the event of challenges being canceled or companies going into liquidation, prizes expire without entitlement. SWFF is entitled, in case of delivery bottlenecks or non-availability of a prize, to hand out a substitute prize that essentially corresponds to the original prize.
The prizes are personal, and SWFF reserves the right to warn the respective winners in the event of suspected violation, and the prizes lose their validity. Furthermore, SWFF reserves the right to exclude the respective individuals from participating in future challenges.
3.6. Premature Termination of the Contest
SWFF reserves the right to cancel or terminate any challenge at any time and without prior notice. SWFF will exercise this right, in particular, if the proper conduct of the challenge can no longer be guaranteed for technical or legal reasons. If such termination of the challenge is caused by the behavior of a participant, SWFF may require this person to compensate SWFF for the damage caused.
3.7. Liability
With the handing over or posting of the prize to the winner, SWFF will be released from all obligations. SWFF shall not be liable for any losses, delays, or damages that may occur to the prize during postal or transport and that are caused by circumstances beyond its control. SWFF is not liable for legal and/or material defects of the prize.
No liability is assumed for lost, damaged, misdirected, incorrect, or delayed entries, as well as for any technical difficulties that could affect the final result of the challenge or participation.
3.8. Miscellaneous
Legal recourse is excluded.
No correspondence will be conducted.
All costs, taxes, and fees associated with winning a prize are borne by the winner.
The participation conditions are subject exclusively to Swiss law.
If individual provisions of the participation conditions are or become invalid, the validity of the remaining participation conditions shall remain unaffected.
The participation conditions may be changed by SWFF at any time without separate notification.
4. Newsletter
Newsletters are only sent if you have explicitly confirmed to us beforehand. If you no longer wish to receive newsletters from us later on, you can unsubscribe at any time.
5. Availability
The operator of the services and SWFF strive for high availability. However, interruptions may occur for maintenance purposes or due to other planned or unforeseeable events.
6. Liability
The use of information, offers, and services from the website and the app, especially the sports offers and the use of the proposed routes (tracks) in the miis Furttal project, is at your own responsibility and risk. The general traffic regulations, which must be strictly observed by users of the website and app miis Furttal," apply. No responsibility can be taken for any damages. Any liability in connection with the information, offers, and services, to the extent permitted by law, is excluded.
If there is a contractual relationship between SWFF and the user of the miis Furttal website and apps, SWFF shall only be liable for damages caused by gross negligence or intent. SWFF shall not be liable for damages caused by an auxiliary person. SWFF is not liable for lost profits, data losses, or any other direct, indirect, or consequential damages resulting from access to elements of the miis Furttal website and app or their use or the impossibility of accessing or using them or from links to other websites or technical disruptions.
7. Security / Data Protection
All data required for processing is stored and used within the miis Furttal project. They will not be passed on to third parties without consultation, see the data protection declaration Project miis Furttal.
8. Changes and Additions
SWFF expressly reserves the right to adapt the present General Terms and Conditions (AGB) to the circumstances at any time and to apply them immediately.
9. Place of Jurisdiction
In case of disputes, an amicable agreement will be sought in any case. If no amicable agreement is reached, Swiss law shall exclusively apply. The place of jurisdiction is the ordinary courts at the seat of SWFF.
This is a translation of the German terms and conditions into English. In case of discrepancies between the English version and the German version, the German version shall prevail.
