1. Scope

Protecting your privacy is important to us. With this privacy policy, we inform you about our data processing methods related to the use of the website miisFurttal.ch and the miisFurttal app, as well as our services and information.

In case of any discrepancies between this privacy policy and the terms and conditions of Standort- und Wirtschaftsförderung Furttal, the provisions of this privacy policy shall prevail.

The SWFF determines the purposes and means of processing your personal data and is therefore responsible for the processing and use of your personal data in accordance with this privacy policy. 3. Personal Data

3.1. Personal data automatically transmitted through the use of the portal

Upon each access to our internet pages, certain usage data is transmitted to us by your internet browser for technical reasons and stored in log files. These usage data include: date and time of accessing our website; name of the accessed webpage; IP address of your internet connection or mobile device; address of the webpage from which you accessed our webpage; amount of data transmitted; and name and version of your browser.

Analyzing the log files helps us to further improve and make our internet offers more user-friendly, to identify and correct errors more quickly, and to manage server capacities. Based on the log files, we can determine, for example, at which time the use of our internet offers is particularly popular and provide corresponding data volume to ensure the best possible use for you.

This personal data is not merged with other personal data and is kept separate from any other personal data transmitted by the user. It is deleted when no longer needed.

3.2. Personal data transmitted by the user

When you make the following personal information on our websites or when using our app, we only need the information for the processing of using the services on the website and in the app:

  • Salutation, first and last name
  • Place of residence, optional telephone number
  • Email address and information about age
  • Scanned QR codes of your sports activities with the app

The provision of this personal data is expressly voluntary. However, without this personal data, we will not be able to provide the requested services to the user in the desired quality or at all.

The SWFF uses the personal data provided by the user for the following purposes:

  • to provide, maintain, protect, and optimize the services and information offered
  • to communicate with you and provide you with the best possible and personalized information you need from us (e.g., about our products and services)
  • to offer you new services and information and to suggest services and information tailored
  • to you based on your profile that may be of interest to you to comply with legal or other regulatory requirements and internal regulations
  • to establish, exercise, and/or defend actual or potential legal claims, investigations, or similar proceedings
  • for other lawful purposes, if such processing arises from the circumstances or was indicated at the time of collection

4. Legal Basis of Processing

The processing of this personal data is based on the following legal bases:

  • Your consent, only if it can be revoked at any time (e.g., if you subscribe to our newsletter and other marketing communications)
  • for the implementation of the challenges
  • to comply with a legal obligation (e.g., for tax reasons or for the purpose of judicial investigations or proceedings) or
  • to protect our legitimate interests (e.g., protection and security of our services, systems, assets; compliance with legal, regulatory, and contractual obligations; assertion, exercise, or defense of legal claims; maintenance and efficient organization of business operations; improvement and development of our services as well as sale and marketing of our services)

Please note, however, that revoking your consent does not affect the lawfulness of the processing carried out based on the consent before its revocation.

5. Disclosure of Personal Data

The SWFF takes the necessary measures to ensure that only our authorized personnel and our assistants who have the necessary knowledge have access to your personal data to fulfill the purposes for which your personal data was collected.

We may disclose your personal data to the following possible categories of recipients in accordance with the purposes and legal bases of the processing described above, as far as necessary for the intended data processing:

  • Service providers who process personal data on behalf and on the instructions of SWFF (so-called data processors such as secretariat, IT, hosting, and support)
  • Customers, partners, suppliers, insurers, and other business partners
  • Courts, arbitration boards, law enforcement authorities, supervisory authorities, lawyers, and other parties in potential or actual legal proceedings, if necessary to comply with laws or to establish, exercise, or defend rights or legal claims.

6. Retention

In principle, personal data will be deleted as soon as it is no longer necessary for the purpose for which it was collected, unless longer storage is necessary to fulfill legal obligations (e.g., retention and documentation obligations), contractual or pre-contractual obligations, or legitimate business interests of ours (e.g., to assert, exercise, or defend legal claims).

On this basis, we generally process personal data in compliance with the following rules and obligations:

  • The personal data automatically transmitted by you through the use of our portal (see point 3.1) for the purpose of displaying, operating, and ensuring the functionality of the portal will be deleted when no longer in use.
  • The personal data transmitted by you to us in connection with the use of our services and products offered on our portal or transmitted to us via the email contact address (see point 3.2) will generally be kept by us until you request deletion, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after completion of processing your request).

We do not assume any liability for loss, incompleteness, unauthorized access to data, or technical errors.

8. Analytical Methods

We use our own analytical methods for the ongoing optimization of our websites. We evaluate the following information:

  • Page views in the last months and in the last 30 days
  • Most accessed pages in the last 30 days
  • Top countries, web browsers, IP addresses, and platforms in the last 30 days This data is stored within the miisFurttal project and is not shared with third parties.

9. Your Rights

You can request information from the SWFF, upon proof of your identity, whether personal data about you is being processed. Furthermore, you have the right to request the correction, destruction, or restriction of personal data about yourself, as well as to object to the processing of your personal data. If the processing is based on your consent or our legitimate interests, you can revoke your consent or object to this processing at any time by contacting us directly by email at geschaeftsstelle(at)standort-furttal.ch. In certain cases, you have the right to receive personal data generated when using online services in a structured, common, and machine-readable format, so that further use and transmission to a potential third party is possible.

Requests in this regard should be addressed to the SWFF at the following email address: geschaeftsstelle(at)standort-furttal.ch. The SWFF reserves the right to limit your rights within the framework of applicable law and, for example, not to disclose comprehensive information or delete personal data. Please note that even after a request for deletion of your personal data, we may have to retain all or part of it in accordance with legal and contractual retention obligations. Deleting your personal data may result in you no longer being able to use our services.

If we reject your request or you are not satisfied with our processing, you are also entitled to lodge a complaint with the competent supervisory authority and to seek legal recourse from the competent authority. The competent authority is the Federal Data Protection and Information Commissioner (EDÖB) in Bern (http://www.edoeb.admin.ch).

10. No Automated Decisions

We do not make decisions about you that are based solely on automated processing – including profiling – and that have legal effects on you or that similarly significantly affect you.

11. Security

The SWFF has implemented organizational and technical measures to maintain the security of personal data and to protect it against unauthorized or unlawful processing, accidental loss, alteration, disclosure, or access.

The SWFF may use third parties as data processors to collect and process your personal data. The data processors we engage will process your personal data only in accordance with our instructions and are legally obligated to take strict security measures when handling personal data.

Unfortunately, transmitting information over the internet is not entirely secure. Although we do our best to protect your personal data, we cannot guarantee the security of the data you transmit to our website; any transmission is at your own risk. For this reason, you are free to transmit your personal data to us in other ways, e.g., by phone. Once we have received your data, we apply strict procedures and rigorous security measures to prevent unauthorized access.

12. Children

Our website is not intended for children, and we do not knowingly collect personal data from children under 16 years of age unless we have express consent from their parents. If we are notified or otherwise become aware that personal data of a child under 16 years of age has been collected improperly, we will take all reasonable steps to delete such personal data.

13. Changes to Our Privacy Policy

This is a translation of the German terms and conditions into English. In case of discrepancies between the English version and the German version, the German version shall prevail.

The SWFF reserves the right to adjust, supplement, or otherwise amend this privacy policy at any time and without stating reasons. The current privacy policy as published on the portal applies.
